Lawsuit Alleging That Nude Photo Shoot in Castle Ruined Photographer’s Life Dismissed

Howard Kennedy, a photographer from Scotland, shot some nude pics in Craigievar Castle, Aberdeenshire, a part of The National Trust and subsequently had his life ruined by the ensuing controversy, a lawsuit alleged.

Unfortunately for him, the story isn’t getting any better as the court dismissed his £50,000 defamation claims because he filed his suit in England, not Scotland.

The reasoning for this is Kennedy claims his business interests in England suffered hence the filing there but the court ruled it didn’t have the right to rule over this because it concerned two parties in Scotland.

The Supreme Court in London wouldn’t take the case because, as FStoppers quotes, it fails to “raise an arguable point of law.” So, what happened exactly? Kennedy claims he had permission from The National Trust to shoot the nude photos of Rachelle Summers. The problem is that this permission was allegedly given orally and not in writing.

It became a point of controversy when the daughter of the person who gifted the ancient pile to The National Trust in 1963, Gabriel Forbes-Sempill, questioned whether or not this was in keeping with the spirit of the gift.

A scandal emerged and The National Trust denied ever granting permission and said it would never do such a thing.

This means that someone is lying or the management of the castle is so loose that they just didn’t stop a nude photoshoot going down on their property. As for how Kennedy will proceed in the future there’s no word as of press but we will keep you informed of any new developments as they emerge.
